1. What is Fractional Real Estate?

Fractional real estate refers to the practice of owning a fraction or share of a property via fractional ownership platforms (FOP), allowing multiple investors to collectively own and benefit from high-value premium real estate assets.

2. How Does Fractional Real Estate Investment Work?

Investors purchase shares in a property, with ownership divided according to the amount invested. Returns, such as rental income and property appreciation, are distributed proportionally among the investors. The property you invest in is held by a Special Purpose Vehicle (SPV), essentially a private limited company. This SPV is used to raise funds, own, and manage the property efficiently. The SPV also ensures that the rental incomes are distributed to shareholders proportionate to their investments.

3. What are the Benefits of Fractional Real Estate?

Benefits include lower entry costs which enhance affordability, an opportunity to diversify investment portfolio, shared maintenance responsibilities, access to premium properties that might be unaffordable individually, and attractive rental yield.

4. What are the taxes applicable on fractional real estate investments?

There are two types of returns that an investor can earn from fractional real estate investments: rental income and capital appreciation.

1. Rental Income:
- Rental income will be considered as interest income in the hands of the investors and taxed according to the investor’s tax bracket.

- At the time of distribution, Tax Deducted at Source (TDS) will be deducted at 10% for resident investors and 31.2% for Non-Resident Indians (NRIs).

2. Capital Gains:
- Long-term Capital Gains (LTCG): - For resident Indians, long-term capital gains tax at 20% with indexation benefit applies for a holding period of more than 2 years.

- For NRIs, the holding period is more than 3 years to qualify for LTCG tax at 20% with indexation benefit.

- Short-term Capital Gains (STCG): - If the holding period is less than 2 years (for residents) or 3 years (for NRIs), the gains will be considered short-term and will be added to your income for that year, taxed according to your income tax bracket.

Recent Regulatory Changes:
- The financial regulator, SEBI, recently issued detailed regulations for listing Small and Medium Real Estate Investment Trusts (SM REITs).

- After listing, all rental incomes will be considered as dividends and taxed according to the investor’s tax bracket. - Capital gains from listed SM REITs with a holding period of more than 12 months will qualify for long-term capital gains tax at 10%.

5. Can I Sell My Fractional Ownership?

Yes, fractional ownership platforms provide access to a secondary market where existing investors can sell their ownership to new investors. However, unlike publicly traded stocks and mutual funds, real estate fractional ownership is less liquid, which may make it more challenging to sell your share in the property promptly.

6. What Types of Properties are Available for Fractional Ownership?

Fractional ownership can apply to various types of properties, including warehouses, commercial real estate, vacation homes, and more.

7. How are Returns on Fractional Real Estate Calculated?

Returns are based on rental income and property value appreciation, distributed proportionally to the shares owned by each investor.
